Please note this is not my horse but came across this ad on Kijiji. Thought I'd post and try and help these people find their horse.

I sent an email to get more info and/or a picture but haven't heard back yet. The new ad makes it sound like the horse was more or less stolen (resold by a person who didn't have the right to do so).

Well, as the saying should go 'seller beware'. I opened this honestly thinking someone LOST their own horse. I can't get a hold of the girl I sold my arab gelding to, I would certainly not call him lost or stolen.

I am really surpirised that the cops are involved with this at all, why did they sell the horse in the first place if he was so important to them.

Well by the sound of it they almost like free leased the horse to this person thinking she would be a good home where maybe he might be able to get some light riding time that they couldn't give, cause in one of the first ads they put up for this horse they still had his papers and the bill of sale. So they didn't sell this horse to the other person and weren't going to or they would have handed over his papers as well. Which is probably why the police are involved in this matter cause the one posting this ad has all the right paperwork to make them legal owners of the horse.

Yes, that is how I understood it to; the horse was on loan with the understanding it would be returned if the person didn't want it. You can't sell a horse you are only borrowing/leasing! I am glad the person is persuing it legally...all to often horse people let themselves be taken advantage of...Buyer Beware is one thing, but this is FRAUD as the seller isn't the owner, just as misrepresenting a horse when selling is fraud.

I think this is a case of a verbal contract gone wrong. People need to educate themselves that verbal contracts and handshakes are no longer strong legal contracts. This is where people are taken advantage of, or huge misunderstandings occur. Put it in writing to protect your assets.

But in this case, a contract wouldn't of been any good. The person who sold the horse had no legal right to do so. They didn't own the horse they were leasing or borrowing it from the owners. And then turned around and sold the thing, even if they had a lease agreement it really doesn't matter as it still comes down to, THEY COULDN"T LEGALLY SELL!!!

But again this is only ONE side of the story too!

The first ad said the horse was given to a farrier on the terms it was a companion and not to be ridden agressivly. Apparently the person was caught riding the horse agressivly and so the original owner wanted the horse back..

The first ad also had the farriers full name which i'm assuming was removed by Kijiji cause in the repost no names are mentioned.

Photos were posted on the ad of the horse.

Sounds to me like a lease/sale that was misunderstood
